Gov. Abbott Appeals Judge’s Order to Release Private Elon Musk Emails to Opponent

In a swift response to a Travis County judge’s temporary restraining order, Governor Greg Abbott’s office filed an emergency petition for a writ of mandamus with the 15th Court of Appeals on Tuesday. The petition argues that the district court lacked jurisdiction to compel the governor to disclose private communications with billionaire Elon Musk.

Abbott’s Legal Position

The governor’s legal team contends that only the Texas Supreme Court can issue mandatory orders against the governor, citing state law that protects the executive branch from lower‑court mandates. The filing states, “Plaintiff’s request sought to abuse her legislative access for personal campaign purposes and contemplated public disclosure of information made confidential by law.”

Hinojosa’s Request and Allegations

State Representative Gina Hinojosa, the Democratic nominee for governor, filed suit on Oct. 19 after Abbott refused to turn over records requested under the Texas Public Information Act. Hinojosa seeks access to the same Abbott‑Musk communications previously requested by The Texas Newsroom. She argues that Texans deserve transparency, noting Musk’s recent $5 million donation to Abbott’s campaign and a history of state grants to SpaceX, school tax breaks for the Terafab project, and direct contributions.

Hinojosa’s complaint also alleges that Abbott described the communications as “intimate and embarrassing,” and that the governor’s office produced 1,374 pages of documents that were largely redacted. The lawsuit emphasizes that the governor’s refusal to allow inspection violates a legislator’s right to request confidential records for legislative purposes.

Governor’s Response

Abbott’s office labeled the lawsuit “a baseless stunt and nothing more than an act of desperation.” The statement added, “State Representative Gina Hinojosa is abusing her official capacity as an outgoing lawmaker for political purposes.” The governor’s team also filed a motion to dismiss the lawsuit in its entirety and asserted that the appeal automatically halts the trial‑court order.

Legal Timeline

The temporary restraining order was granted on Monday, and a hearing on a temporary injunction is set for Monday, Nov. 2 at 9 a.m. Abbott’s attorneys have asked the appeals court for a ruling by 5 p.m. Tuesday so the governor can seek relief from the Texas Supreme Court before the district court’s Thursday deadline, which would grant Hinojosa access to the private communications.

Context and Implications

While Hinojosa is not seeking to make the communications public, Texas law would require her to keep any confidential records private and allows the governor to require a confidentiality agreement before inspection. The dispute highlights the tension between legislative oversight and executive privilege, especially as the governor faces a high‑stakes election on Nov. 3.

Observers note that the case underscores the importance of safeguarding the governor’s ability to conduct confidential negotiations, particularly with major investors like Musk, whose contributions have been framed by the governor as vital to Texas’s economic growth.
