Fresno City Council Sets Aside $1 Million for Immigrant Legal Defense Fund

The Fresno City Council voted Thursday to create a $1 million legal defense fund aimed at assisting city residents confronting immigration detention. Councilmember Miguel Arias sponsored the agenda item, and the measure passed with a 5‑1 vote after an amendment restricted eligibility to those who have not been convicted of any criminal offense.

Supporters Emphasize Family Unity

Advocates for immigrant rights praised the decision. “There is no right to a court‑appointed attorney in immigration court,” said Sukaina Hussain, deputy executive director of the California Immigrant Policy Center. “When a Fresno resident is detained, they can be facing deportation in just a couple of days with no one in their corner. Having a lawyer and a fund that can provide support can severely change that outcome and help keep families together.”

Hussain added that she hopes the investment becomes a recurring resource and that the city partners with “trusted” community service providers to deliver the aid.

Opposition Cites Equal‑Treatment Concerns

Two members of the public voiced objections. Neil O’Brien argued that creating a special legal benefit for one group of residents “creates two classes of people.” Councilmember Nick Richardson registered the lone “no” vote, noting that the amendment limiting eligibility was necessary to address concerns about fairness.

Context of Prior Funding

This is not Fresno’s first foray into immigration‑related legal assistance. Five years ago the council allocated $200,000 toward a similar fund after a split vote. Councilmember Mike Karbassi, who voted against that 2021 budget motion, explained that his opposition stemmed from a promise to voters to prioritize additional police officers and firefighters, not from the specific immigration‑defense provision.

Related City Actions

During the same meeting, the council approved several other initiatives. A pilot program designating a weekend vendor zone in the Tower District received unanimous support. Mayor Jerry Dyer highlighted added lighting, security cameras, and police presence to ensure safety. The council also approved a two‑year, $950,000 agreement for the Advance Peace program and a $4.3 million contribution toward an affordable modular housing project for seniors along the Blackstone corridor.

Future Considerations

Councilmembers approved a resolution, sponsored by Karbassi, to explore an ordinance that would limit the number of group homes for sex offenders in the city. While the proposal faces legal scrutiny, it reflects ongoing efforts to address community safety concerns.

Overall, the $1 million legal defense fund represents a targeted response to the surge in immigration enforcement across California and the Central Valley as the midterm election cycle approaches. The council’s decision underscores a commitment to protecting families while balancing fiscal responsibility and public‑safety priorities.
