Four States Sue Trump Administration Over New Medicaid Work Requirement

Attorney General Keith Ellison of Minnesota, joined by his counterparts in Oregon, New Mexico and Washington, filed a sweeping federal lawsuit on Thursday seeking to block a new Medicaid work mandate slated to take effect on Jan. 1, 2027. The states argue that the requirement – which would force able‑bodied adults ages 21 to 64 to record at least 80 hours of employment, education or volunteer service each month – amounts to unconstitutional coercion that threatens billions of dollars in federal health funding.

Administration’s Rationale

The Trump administration defends the rule as a commons‑sense effort to encourage personal responsibility and reduce dependency on government assistance. In a statement released by the White House, officials said the policy is intended to “empower individuals to achieve economic self‑sufficiency while preserving the integrity of the Medicaid program for those who truly need it.” They contend that requiring a modest level of productive activity helps ensure that limited federal resources are directed toward the most vulnerable.

State Plaintiffs’ Concerns

Ellison called the mandate a “bait‑and‑switch” that turns a 60‑year‑old safety net into an administrative trapdoor. “Medicaid was built to keep poor people healthy, not to dangle doctor visits like carrots to make people punch a clock,” the lawsuit alleges. The plaintiffs warn that the added paperwork and hour‑tracking could push thousands of low‑income adults out of the health system and into emergency rooms.

State officials estimate that between 128,000 and 243,000 residents could be required to verify work activity, depending on which agency’s figures are used. Even the lower estimate represents a substantial portion of the roughly 1.2 million Minnesotans who rely on the state’s Medical Assistance program. Analysts project that up to 140,000 individuals could lose coverage if the rule is enforced without modification.

Legal Basis of the Challenge

The coalition argues that the mandate violates the Constitution’s Spending Clause by effectively holding a “gun to state capitols” – threatening to withdraw federal Medicaid funds unless states comply. Medicaid, established in 1965 as a partnership between the federal government and the states, has traditionally allowed states flexibility in administering benefits. The plaintiffs contend that the new requirement eliminates that flexibility and imposes an unlawful condition on federal aid.

Precedent and Potential Impact

Critics point to a 2018 pilot in Arkansas that resulted in more than 16,000 people being removed from Medicaid rolls within months. A federal judge later halted the experiment after evidence showed the policy did not increase employment and instead created administrative burdens that led to loss of essential medical care, including insulin for diabetics.

If the lawsuit succeeds, it could halt the rollout of the work requirement nationwide, preserving current Medicaid coverage for millions of low‑income adults. Conversely, a court ruling in favor of the administration could set a precedent for tying federal funding to work‑related conditions, reshaping the landscape of public assistance programs.

What Comes Next

The case is expected to be heard in a federal district court later this year. Both sides have indicated they will appeal any adverse ruling, suggesting a prolonged legal battle that could extend into the 2028 election cycle. The Centers for Medicare & Medicaid Services declined to comment on the pending litigation.

For families and community members who rely on Medicaid, the outcome of this lawsuit will have direct consequences on access to health care and the stability of state budgets. As the debate unfolds, the Trump administration remains firm that the policy is a necessary step toward fostering personal responsibility while safeguarding the program’s long‑term viability.
