Fifth Court of Appeals upholds life sentence for Ebby Wade in Sherman murder case

SHERMAN, Texas – The Texas Fifth Court of Appeals in Dallas has affirmed the murder conviction of Ebby Wade, upholding his life sentence for the 2020 killing of 21‑year‑old Emilia Gunnels. The decision, announced on Monday, confirms that Wade must serve at least 30 years before he becomes eligible for parole in 2051.

District Attorney highlights seriousness of the crime

Grayson County District Attorney John Kermit Hill said the affirmation sends a clear message that violent offenders will remain off the streets. “This absolute criminal is off our streets and is not around to hurt anyone else,” Hill said, adding that the ruling does not lessen the family’s loss but does provide some measure of justice.

Hill also noted that Gunnels’ independence played a role in the motive. “She was very serious about who she was as a person and her independence and desire not to be in a relationship with the defendant was probably a factor that encouraged him,” he explained.

Details of the 2020 homicide

According to court records, Wade, 49, strangled and sexually assaulted Gunnels before dumping her body in a creek near Sherman. Both victims had worked together at FedEx in the city, and investigators reported that Wade told police he had romantic feelings for Gunnels, which were rejected.

The case waited three and a half years before going to trial. A Grayson County jury convicted Wade of murder and sentenced him to life in prison with the possibility of parole. Wade has continued to challenge the conviction, filing multiple post‑judgment motions and appealing to the Dallas Court of Appeals.

Legal process and next steps

The Fifth Court of Appeals’ affirmation comes after more than six years of legal proceedings, including the original trial, sentencing, and a series of appeals. The appellate court found no reversible error in the trial court’s handling of the case, thereby leaving the original life sentence intact.

Hill emphasized that the ruling does not change the family’s grief. “A terrible situation for the family. They’re going to continue to suffer this loss. We can’t take that away. We can’t make it better,” he said, while also noting the community’s relief that a dangerous offender will remain incarcerated.

Community response

Local residents expressed a mixture of sorrow for Gunnels and a sense of safety knowing the perpetrator will remain behind bars. Community leaders reiterated the importance of supporting victims’ families and ensuring that justice is served promptly and fairly.

The affirmation of Wade’s conviction underscores the persistence of Grayson County law enforcement and prosecutors in pursuing justice, even when cases extend over many years.
