When tragedy struck Silver Rail Elementary School in Bend, the parents of victim Rhoam Summer turned to a trio of law firms for help. Tim Williams, a Bend attorney whose firm is part of the three‑firm team, told KTVZ why the parents acted quickly and what they hope to achieve.
Why three firms?
Williams said each firm brings a distinct strength. “Jeffrey (Simon’s) firm has deep experience with school‑security issues, Roger (Worthington) lives locally in Bend and runs Worthy Brewing while also practicing law, and I specialize in Oregon tort law,” he explained. Together they form a “powerhouse” that has handled major climate litigation, making the partnership a natural fit for the complex questions raised by the shooting.
Not a rush to sue
The attorneys stress that no lawsuit has been filed yet. “This is an investigation,” Williams emphasized. “We’re looking to see if anyone or any entity might be liable, and if so, the family can decide what to do next.” He added that any parent who has lost a child would understandably seek to understand responsibility.
Potential criminal angles
Williams noted that while the shooter is dead, there could be criminal implications for the mother if she provided a firearm to a minor, which is illegal in Oregon. He clarified that he is not a criminal lawyer and has not spoken with law‑enforcement or the district attorney, so he cannot predict any charges.
Media management and community protection
The first morning after the shooting, reporters knocked on the family’s door. “They were distraught and didn’t know how to handle the media,” Williams said. The law team stepped in as spokesperson, helping the family issue a statement and protect Rhoam’s legacy.
Williams also said that if their independent investigation uncovers safety failures, they will share the findings with the school district and law‑enforcement. “Our dedication to the community and the protection of children is first and foremost,” he affirmed.
Deterrence and community impact
When asked whether the legal effort is about financial gain, Williams responded that the goal is accountability and deterrence. “If a party is found at fault, a settlement can send a clear message that such negligence will not be repeated,” he said. He added that successful outcomes can inspire other communities to improve school safety, noting the deep support the family has received from local donors.
Williams concluded by acknowledging the emotional weight of the situation. “It’s surreal and heartbreaking,” he said, “but the legal process is the only way to seek justice and potentially prevent future tragedies in our town.”
