Alaska’s Judicial Retention Process Faces Criticism Ahead of 2026 Election

As Alaska prepares for the November 3, 2026 general election, conservative advocates are warning voters that the state’s judicial retention system is heavily tilted toward liberal interests. The Alaska Judicial Council (AJC), a body largely composed of members of the Alaska Bar Association, screens judicial candidates before they are sent to the governor for confirmation. Critics say the council’s composition and procedures effectively block conservative judges from advancing.

How the selection process works

The system, modeled after the Missouri Plan, relies on a six‑member AJC. Three members are attorneys appointed by the Bar Association and are not confirmed by the legislature. The other three are non‑attorneys chosen by the governor and must be confirmed by the legislature. The council interviews candidates and forwards its selections to the governor. If the council’s vote is tied, the chief justice of the Alaska Supreme Court casts the deciding vote.

Conservative groups raise concerns

Alaska Family Council, a faith‑based organization that has monitored the process since 2006, contends that the AJC’s attorney members are overwhelmingly liberal. Their own data show Bar Association members identifying as Democrats at 27.48% versus Republicans at 15.85%, a stark contrast to the state’s electorate where Republicans outnumber Democrats 24.25% to 12.83%.

According to the group, this partisan imbalance means that candidates labeled “conservative” are routinely deemed unqualified, regardless of their experience. Even when a Republican governor appoints non‑attorney members to the council, those members often align with the attorney majority, further limiting conservative representation on the bench.

Impact on recent judicial decisions

Critics point to the Alaska Supreme Court’s interpretation of the state constitution’s privacy clause as creating a de facto “right to abortion,” a stance they argue conflicts with the U.S. Constitution as clarified by the Supreme Court’s Dobbs decision. They claim that a liberal‑leaning judiciary is responsible for this outcome.

Calls for reform

Reform proposals include amending the state constitution to require the AJC to forward all qualified candidates to the governor, removing the council’s discretionary “qualified” filter. Another option is to convene a constitutional convention, scheduled for a vote in 2030, to overhaul the selection process.

Both paths face significant hurdles. Achieving the two‑thirds majority needed for a constitutional amendment is challenging in a legislature where a few power‑hungry Republicans have historically enabled Democratic dominance on judicial matters.

What voters are being told

In an effort to influence the upcoming retention vote, a local activist shared a message urging voters to “vote no on all the judges” unless they receive a private recommendation for a few vetted candidates. The activist cautioned that publicly identifying supportive judges could lead to their removal by the AJC.

Early voting for the 2026 general election is already underway, and the group encourages Alaskans to consider the judicial selection issue when casting their ballots.
