NFIB Michigan State Director Amanda Fisher testified before the Michigan Senate Committee on Labor on Senate Bill 948, which would limit employer communications with employees outside of regular work hours. NFIB opposes the bill, citing its one-size-fits-all mandate that will have an unfair impact on small businesses compared to large corporations.
Concerns Over Unintended Consequences
Fisher expressed concerns that the broadly written government mandate will have a lasting negative impact on Michigan’s small businesses if passed. The Federal Labor Standards Act (FLSA) already prohibits employers from requiring non-exempt employees to perform unpaid work, including answering work emails.
The legislation would severely impact exempt employees, who tend to be salaried and often work irregular hours. Fisher noted that small business owners, who often serve in multiple roles, would be particularly challenged by the bill.
