The City of St. Matthews is facing a lawsuit after denying a proposed apartment complex in April. The proposed development, called Gilamans Pointe, was a 200-unit apartment complex set to be built off Westport Road and Ridgeway Avenue.
Lawsuit Details
In the lawsuit filed by LDG, it claims the City of St. Matthews denied the development using an ordinance that grants them power to use discretion when reviewing projects, even if they are compliant with city code. LDG is asking for the ordinance to be declared invalid under state law. If that request is denied, LDG is asking to appeal the council’s decision.
LDG released a statement saying, “This complaint reflects our belief that the City of St. Matthews acted unlawfully by enacting and enforcing an ordinance aimed at Gilmans Pointe, and allows the St. Matthews City Council to arbitrarily deny businesses and homeowners the right to build in accordance with the law.”
WLKY reached out to the City of St. Matthews for comment, but they have not responded.
