Montana AG Asks Court to Dismiss Case

Montana Attorney General Austin Knudsen filed a new response in court on Monday, asking the state supreme court to dismiss the Gallatin County Attorney’s case against him, calling it ‘political.’ The dispute began in April over Immigrations and Customs Enforcement (ICE) actions, specifically requesting documents in Gallatin County that the county attorney did not grant.

Background of the Dispute

Knudsen has argued that ICE, as a criminal justice agency, is entitled to any records it requires without examination from officials, and the Gallatin County Attorney is arguing that ICE does not qualify as a criminal justice agency under the law in Montana. As Attorney General, Knudsen wrote on social media that he has the authority to invoke supervisory control over Gallatin County Attorney Audrey Cromwell’s office, and therefore, the court should dismiss this case.
