U.S. Election Betting Markets Face Insider Trading Challenges

As the U.S. midterm elections draw near, prediction markets such as Kalshi and Polymarket are facing increased scrutiny over potential insider trading. These platforms, which allow users to bet on election outcomes, have seen a surge in suspicious trades, prompting concerns about market integrity and the potential for insider trading.

Challenges in Monitoring

Kalshi recently suspended three congressional candidates for betting on their own races, and former congressman George Santos is under investigation for possible insider trading on the platform. With over 6,590 state and federal legislative seats up for election this year, the potential for insider trading is significant, according to experts.

Insider trading in prediction markets remains a legally ambiguous area, and the Commodity Futures Trading Commission (CFTC), which is seeking jurisdiction over these markets, is already stretched thin. Ilya Beylin, a professor at Seton Hall Law School, notes that the response to insider trading in these markets may be slow or nonexistent, which could undermine public trust in the democratic process.

Efforts to Bolster Controls

Both Kalshi and Polymarket are implementing measures to combat insider trading. Kalshi has blocked election trades by politicians and campaign workers, while Polymarket is focusing on preventing trades based on private information. The U.S. Senate has also banned members and staff from participating in prediction market betting.

Despite these efforts, the complexity of the markets continues to grow. Polymarket, for example, has expanded its markets to include bets on various election-related variables, such as voter turnout and margin of victory, which increases the potential for information asymmetry and insider trading.

With the CFTC’s enforcement staffing at its lowest level in 20 years, there are concerns about the agency’s ability to handle the volume of referrals from these markets. However, the CFTC spokesperson stated that the agency is committed to enforcing the law aggressively and is relying on experienced personnel to manage the workload.
