Hyde‑Smith campaign urges Mississippi counties to safeguard affidavit ballots

Attorneys representing U.S. Sen. Cindy Hyde‑Smith have dispatched a formal letter to all 82 Mississippi county election commissioners and circuit clerks. The correspondence, obtained by local media, demands that any affidavit ballots cast in the November 3, 2026 general election be isolated, sealed and retained until the canvass, certification and any post‑election review are complete.

Legal basis for the request

The letter cites Mississippi Code § 23‑15‑911, which outlines post‑election handling, security and examination of ballot boxes after primary and general elections. It also references federal record‑keeping requirements that mandate preservation of covered federal‑election records for 22 months from the date of the election.

Specifically, the attorneys write, “Each county must maintain these ballots and their associated records separate and apart from other 2026 general election ballots throughout the duration of the canvass, certification, and completion of the election process, as required by Mississippi and federal law.” The letter reminds counties that affidavit ballots must be sealed in an envelope bearing the voter’s written and signed affidavit and name, then recorded in a separate receipt book.

What the letter requires

County officials are instructed to keep the separation and preservation measures in place through any ballot‑box examination, election contest, runoff or other authorized post‑election activity. The attorneys stress that these safeguards must not delay lawful tabulation, prevent counting of any legally cast ballot, or compromise ballot secrecy.

At the end of the letter, counties are asked to confirm by 5 p.m. Thursday that the requested safeguards are operational.

Local party response

Mississippi Republican Party Chairman Mike Hurst held a press conference outside the Hinds County Courthouse, describing the letter as “standard procedure for an election this close.” He emphasized the party’s goal of ensuring that laws are followed and that no evidence is destroyed, whether accidentally or intentionally.

Election context

The race for Mississippi’s U.S. Senate seat remains too close to call. Democrat Scott Colom leads Hyde‑Smith by 1,724 votes, with Colom at 466,226 votes (49%) and Hyde‑Smith at 464,502 votes (48.9%). Colom’s campaign manager Gerard Henderson called the letter a “desperate stunt from national Republicans” and expressed confidence that every lawful ballot will be counted, securing a win for Colom.

Why the preservation request matters to voters

Affidavit ballots are used when voters cannot appear at their assigned polling place and must cast a vote elsewhere. By keeping these ballots separate and sealed, counties can more easily verify their authenticity and ensure they are not inadvertently mixed with regular ballots during the certification process. This transparency aligns with both state statutes and federal oversight, reinforcing confidence in the final vote tally.

For Mississippi voters, the letter underscores the importance of adhering to established legal safeguards during a tightly contested election. County clerks who confirm compliance will help maintain the integrity of the electoral process and provide a clear audit trail should any post‑election disputes arise.

Next steps

County election officials are expected to respond to the attorneys’ request by the Thursday deadline. The certification of the 2026 general election results will follow the standard timeline, with any challenges or runoff elections addressed according to state law.
