NY Attorney General appoints Cornell alumna to lead investigation of campus rape allegation

New York Attorney General Letitia James announced Wednesday that she has appointed former Southern District of New York prosecutor Jackie Kelly to lead the criminal investigation into a rape allegation made by a former Cornell University student. Kelly, a Cornell alumna, brings extensive experience prosecuting sexual offenses in federal court and now works at Boies Schiller Flexner, where she represents victims of sexual assault.

Background of the case

The allegation, filed under the name “Jane Doe,” claims that in 2024 she was gang‑raped by a group of men at the Chi Phi fraternity house on Cornell’s campus. All seven fraternity brothers identified in the complaint have denied any wrongdoing. In 2024, Tompkins County District Attorney Matthew Van Houten concluded that, while the conduct described was “morally disturbing,” it did not meet New York’s legal definition of rape. He opted to present the evidence to a grand jury before Governor Kathy Hochul removed him and appointed James as special prosecutor.

Kelly’s qualifications

Kelly served as the inaugural Civil Rights Unit Chief for the Criminal Division in the Southern District of New York. During her tenure, she oversaw high‑profile prosecutions, including cases involving music mogul Sean Combs and fashion executive Peter Nygard, as well as numerous sex‑crime matters. Her federal experience, combined with her current work advocating for survivors of sexual assault, positions her to conduct a comprehensive review of the evidence.

Attorney General’s expectations

James said, “The Office of the Attorney General is committed to a thorough investigation guided only by the facts, the evidence, and the law. Jacqueline Kelly is a seasoned prosecutor who has overseen numerous cases from investigation through trial. With her criminal legal expertise, commitment to public service, and judicial experience, I am confident that she will lead a fair and comprehensive investigation.”

Kelly’s statement

Kelly thanked the Attorney General, stating, “All New Yorkers deserve a fair and thorough inquiry into the facts of this case. I look forward to lending my years of experience as a federal prosecutor to the Office of the Attorney General as we examine all available evidence.”

Political context

Governor Hochul’s decision to replace the Tompkins County district attorney and to empower James with special‑prosecutor authority underscores the state’s commitment to addressing sexual‑assault allegations on college campuses. Critics, including two of the fraternity brothers named in a related civil lawsuit, have questioned James’s impartiality, citing a prior social‑media post. Attorney Stuart Bernstein, representing one of the brothers, argued that James’s rapid assignment to the case creates a “serious appearance of prejudgment.”

Investigation timeline

The Attorney General’s office indicated that there is no statutory deadline for concluding the investigation. While there is no statute of limitations for the most serious sex offenses in New York, the two‑year limitation for misdemeanor offenses has already expired.

What’s next

Kelly will gather and analyze all available evidence, conduct interviews, and determine whether the allegations merit criminal charges. The investigation will proceed under the oversight of the Attorney General’s office, with any potential charges to be presented to a grand jury if appropriate.

Community response

Students, faculty, and local residents have expressed a range of reactions, from calls for swift justice to concerns about due process. The case highlights ongoing debates about campus safety, the handling of sexual‑assault claims, and the role of state authorities in university matters.
