The family of Kevin Oliveira, a musician from Palm Beach County, has filed a wrongful death lawsuit against Botanic Tonics LLC, the maker of a kratom-based drink called Feel Free Classic. The lawsuit also targets several local retailers that sold the product, claiming it played a role in Oliveira’s untimely death.
Local Impact and Family Concerns
Kevin Oliveira, who performed in West Palm Beach, began using Feel Free Classic in 2023, believing it to be a safe and nonaddictive way to enhance his focus on his music career. However, his family claims the drink led to addiction, seizures, and other health issues. In April 2025, Oliveira was found unresponsive with a bottle of the drink beside him. The Palm Beach County medical examiner reported that Oliveira died after ingesting high levels of mitragynine, a compound found in kratom.
Francisco Oliveira, Kevin’s father, expressed his grief, stating, “We hope that people can see our story — our hearts are bleeding — and realize that some of their loved ones could be in danger because this, this drug is a poison.”
Legal and Safety Concerns
The lawsuit argues that Botanic Tonics LLC and the retailers were aware of the risks associated with the product but continued to sell it without adequate warnings. Attorney Joseph Osborne noted that the product lacks warning labels on its packaging, requiring consumers to visit the website for safety information.
Adriana Oliveira, Kevin’s mother, shared her regret, saying, “I wish I had done more, and I didn’t. It was just too painful.” The family’s attorneys emphasize that the lawsuit aims to raise awareness about the potential dangers of kratom products, beyond seeking financial compensation.
Feel Free Classic is available in smoke shops and other retail outlets, often used by individuals seeking relief from anxiety. However, the case highlights the need for caution and awareness regarding kratom’s addictive potential.
