Mobile, Ala. – The latest court documents reveal that Window Depot of the Gulf Coast’s bankruptcy debt has increased by almost $586,000. The amended schedules, filed on Oct. 26 in the U.S. Bankruptcy Court for the Southern District of Alabama, list total liabilities of $1,913,096.76 with $0 in reported assets.
Changes to the creditor list
When the company entered Chapter 7 bankruptcy on Sept. 1, it reported $1,327,215.94 in liabilities. The new filing adds specific amounts for dozens of creditors that were previously listed as owed only $1. Amounts now range from under $1,000 to more than $28,000. Some creditors remain listed at $1.
Among the updated claims is Kate Morrison, who spoke with FOX10 Investigates earlier this year. Morrison’s claim has been revised to $9,777.
Business creditors remain the same
The largest business creditors and their amounts have not changed from the original filing. The Provia debt, dating back to February 2023, remains listed, and Provia told FOX10 Investigates in May that Window Depot is no longer an active customer.
The filing also identifies Theresa Fendley, who signed the document as the company’s representative, as the owner. Her husband, Ward Fendley, owner of All Weather Roofing, was named in the original filing as a codebtor, meaning he is jointly liable for at least one of the company’s debts.
Criminal investigation continues
Window Depot and All Weather Roofing and Construction are the focus of a criminal investigation that FOX10 Investigates has been tracking. In late May, FOX10 News reported that dozens of customers claimed they paid for services that were never performed.
In July, Mobile Public Safety Director Curtis Graves said police were investigating more than 100 criminal cases related to the businesses. On Sept. 30, the Mobile Police Department handed the case to the Mobile County District Attorney’s Office for review. Prosecutors will decide whether Ward and Theresa Fendley will face criminal charges.
When asked for an update, Mobile County District Attorney Keith Blackwood said he had no new information. As of now, no charges have been filed against the Fendleys.
Company response
FOX10 Investigates reached out to Theresa Fendley’s attorney, William Poole, for comment on the amended filing but has not received a response.
We will continue to monitor the bankruptcy proceedings and the related criminal investigation, and will update readers as new information becomes available.
