EU Court Supports Meta’s Marketplace in Gatekeeper Dispute, Messenger Not Spared

The European Union’s second-highest court has delivered a mixed verdict in Meta Platforms’ ongoing battle against the European Commission’s designation of its services as gatekeepers under the Digital Markets Act (DMA). The court ruled in favor of Meta concerning its Marketplace platform, while upholding the gatekeeper label for its Messenger app.

Marketplace vs. Messenger

The General Court found that the decision to classify Marketplace as a gatekeeper did not meet the necessary requirements for reasoning. This lack of clarity meant that Meta could not fully understand the rationale behind its classification as a core platform service, nor could the EU courts effectively review the decision. As a result, the court sided with Meta, allowing the company to continue operating Marketplace without the gatekeeper label.

However, the court did not extend the same relief to Meta’s Messenger app. The European Commission had previously argued that both Marketplace and Messenger serve as significant gateways for businesses to reach consumers, based on quantitative criteria outlined in the DMA. The court’s decision to uphold Messenger’s gatekeeper status means that the app will remain subject to the DMA’s regulations, which aim to curb the power of major tech companies and foster a more competitive environment.
