The Arizona Supreme Court has granted a new trial for Ricky Hippensteel, who was previously convicted of second-degree murder in the 2021 stabbing death of his friend, Derek Odle. The court’s decision, announced on June 1, reverses Hippensteel’s conviction due to errors identified in the jury instructions during the original trial.
Hippensteel, 55, was serving a lengthy prison sentence following his conviction by a Maricopa County jury. The incident occurred on June 25, 2021, during an altercation between Hippensteel and Odle. Throughout the trial, Hippensteel maintained that he acted in self-defense. Despite his claims, the jury found him guilty of second-degree murder, unlawful flight, and resisting arrest.
The victim’s girlfriend testified that she witnessed Hippensteel assault Odle before calling 911. However, on appeal, Hippensteel’s defense argued that the jury was provided with an incorrect verdict form, which may have influenced their decision.
Upon reviewing the case, the Arizona Supreme Court identified three significant errors in the verdict form. These errors led to conflicting jury instructions, potentially affecting the jury’s ability to properly consider whether Hippensteel’s actions constituted provocation manslaughter rather than second-degree murder.
The case has been remanded to the lower court for a new trial, where these issues will be addressed. This decision underscores the importance of accurate jury instructions in ensuring fair trials and upholding the principles of justice.
