Atascadero homeowner’s bravery leads to conviction of residential burglar

San Luis Obispo County, Calif. – A homeowner in Atascadero helped secure a conviction after confronting a repeat burglar who attempted to break into her home multiple times in October 2025. Gary Lee Roberts II was found guilty of first‑degree residential burglary and attempted burglary by a San Luis Obispo County jury.

Repeated attempts and video evidence

On Oct. 6, 2025, the victim’s security camera captured Roberts knocking on her front door and asking for a person named “Jeff.” When the homeowner responded through the system that no one by that name lived there, Roberts left the premises. The victim had never met him before.

The following morning, while the homeowner was at work, Roberts returned wearing a mask, hat and hooded sweater. The camera recorded him trying the front door, searching a planter box and turning over rocks, apparently looking for a spare key. After about a minute he left, only to return later and continue his search. The homeowner again warned him through the security system that she was recording, prompting Roberts to flee.

Final encounter and victim’s intervention

On the morning of Oct. 9, 2025, the camera again showed Roberts on the property, this time carrying personal items that belonged to the homeowner. She called law enforcement, drove home, and waited for officers. As Roberts attempted to leave, the homeowner confronted him, pushed him into nearby bushes and struck him in the face. Police arrived moments later and detained Roberts at the scene.

District Attorney Dan Dow praised the homeowner’s actions, stating, “This victim showed extraordinary courage. When she saw him walking out her door with her belongings, she faced him directly and made sure he could not run off before officers arrived.”

Legal proceedings and upcoming sentencing

Roberts waived his right to a jury on several outstanding charges while in custody. He is scheduled for a sentencing hearing on Oct. 19, 2026, before Judge Crystal T. Seiler. The court will consider aggravating factors, including a 2015 felony conviction for assault with a deadly weapon.

Investigators noted that the rear sliding‑glass door was shattered and the home was ransacked. A hammer found inside, believed to have been used in the break‑in, did not belong to the homeowner.

Community response

The case underscores the importance of vigilant homeowners and rapid police response in protecting neighborhoods. “Everyone deserves to feel safe in their own home,” DA Dow added. “This verdict shows our criminal and victim‑justice system working the way it should: a victim who spoke up, officers who responded quickly, a prosecutor who presented the evidence with care, and a jury that carefully weighed the facts.”
