Arizona appeals court orders new sentencing after AI victim video deemed unreliable

PHOENIX — In a landmark decision, the Arizona Court of Appeals has vacated the 10‑year manslaughter sentence imposed on Gabriel Paul Horcasitas for the 2021 fatal shooting of Christopher Pelkey. The panel found that an artificial‑intelligence video depicting Pelkey speaking to the judge could not be relied upon as evidence.

AI video crossed the line

The three‑judge panel wrote that the AI rendering “does not reflect actual events” and presents statements as if they came directly from the victim, rather than documenting a real moment. The court concluded the video was created from the imagination of Pelkey’s sister, Stacey Wales, and therefore violated due process protections.

Legal arguments

Horcasitas’ appellate lawyer, Kristen Reller, argued that the lower‑court judge, Todd Lang, erred by allowing the AI‑generated victim impact statement to influence sentencing. Prosecutors and victim‑advocate attorney Jessica Gattuso maintained that the footage accurately reflected Pelkey’s character, but the appeals court disagreed.

Background of the case

Horcasitas, 55, shot Pelkey, 37, during a November 2021 road‑rage incident at a Chandler stoplight. Pelkey, who was unarmed, was shot after exiting his truck and walking toward Horcasitas’ vehicle. Horcasitas was convicted of manslaughter and endangerment for a stray bullet that struck another car.

During the May 2025 sentencing hearing, the AI‑generated video was played after nine family members and friends gave statements. The rendering had Pelkey expressing a wish to remain with his loved ones, a belief in forgiveness, and a sentiment that “in another life, we probably could have been friends.” The video did not request a specific prison term.

Court’s reasoning

Reller told the appeals court that the video’s authorship was unclear and that it carried “undue emotional weight,” creating an authenticity that would not have existed if a family member had simply read the words aloud. The court noted that the lower‑court judge’s comment that he “loved that AI” did not constitute a formal finding that the video factored into the sentencing decision.

Implications for AI in courtrooms

While AI is increasingly used for administrative tasks, legal research, and case preparation in Arizona, this is the first known instance of an AI‑generated victim impact statement being presented at a sentencing hearing. The ruling underscores the need for clear standards on the admissibility of synthetic media in judicial proceedings.

Both sides declined to comment further on the decision.
