Although there is no nationwide count of squatting incidents, lawmakers are acting. As of July 2026, the National Apartment Association reported that 28 states have enacted laws specifically addressing illegal occupancy, and another 25 states are considering similar measures. These statutes often provide faster removal procedures and harsher penalties for fraudulent lease documents.

Documented cases illustrate the problem’s scale. A New York City Department of Investigation review found 548 vacant NYCHA apartments occupied without permission, leading to joint operations that reclaimed 60 units and resulted in 81 arrests.
