83-year-old woman killed in dog attack on Darke County home

Darke County Sheriff’s Office deputies responded to a call at about 11:24 a.m. on Monday at a residence on Clapp Road after a neighbor reported an unresponsive woman in the driveway. The woman, identified as 83‑year‑old Mildred Malott, had walked over to the neighboring house to ask about chickens she had found near her own property earlier that morning.

According to the sheriff’s office, Ms. Malott stepped onto the back porch of the home and was immediately attacked by three mixed‑breed dogs that were let outside shortly before the incident. The dogs mauled her, and she later died from the injuries.

Dog owners’ response and law enforcement action

The owners of the dogs awoke to the commotion, stepped outside, and called 911. Police say the family owns five dogs in total; three were outside at the time of the attack, while the remaining two were inside the house. All five animals were taken into custody by the county’s dog warden. The two dogs that were not involved in the attack were later returned to their owners.

After reviewing the case, the Darke County Prosecutor’s Office will file documents to classify the three attacking animals as “vicious dogs” under Ohio’s recently enacted law that addresses dangerous canine behavior. The owners will be cited for violating that law, a misdemeanor offense.

New Ohio law on vicious dogs

Ohio’s new legislation, passed in 2024, strengthens penalties for owners of dogs deemed dangerous after an attack. The law requires owners to secure their animals, allows for the seizure of dogs involved in serious injuries, and imposes misdemeanor charges for violations. County officials say the law is intended to protect residents, especially seniors and children, from preventable attacks.

Darke County Sheriff’s Deputy James Harris emphasized that the swift response and the application of the new law demonstrate the county’s commitment to public safety. “Our priority is to ensure that tragedies like this are not repeated,” Harris said. “Owners must take responsibility for their animals, and the law provides clear consequences when they do not.”

Community reaction

Neighbors expressed shock and sorrow over the loss of Ms. Malott, a longtime resident known for her involvement in local church activities. Several community members called for stricter enforcement of animal‑control regulations and urged fellow pet owners to be vigilant about securing their dogs.

The incident has also reignited discussion among local officials about the need for ongoing education on responsible pet ownership, particularly in rural areas where animals often roam freely.

Authorities continue to investigate the circumstances surrounding the attack and will hold a hearing on the misdemeanor citations in the coming weeks.
