Legal experts warn Supreme Court decision on Boulder climate case could reshape nationwide regulation

Legal analysts and constitutional scholars are warning that the U.S. Supreme Court’s upcoming decision in Suncor v. Boulder County could have far‑reaching consequences for climate‑change litigation nationwide. The case, scheduled for oral arguments on Oct. 5, seeks billions of dollars in damages from energy companies for their alleged contributions to global warming.

Local plaintiffs invoke the Clean Air Act

Lawyers for Boulder County, Colorado, argue that the Clean Air Act and state nuisance laws give local leaders the authority to address in‑state harms caused by out‑of‑state conduct, such as the design of automobiles or the sale of asbestos. In a brief filed with the high court, they wrote, “There is no constitutional bar to states addressing in‑state harms caused by out‑of‑state conduct.”

Constitutional concerns raised by scholars

University of Virginia constitutional law professor Saikrishna Prakash cautioned that Colorado’s arguments could be interpreted as a nationwide regulatory scheme that would violate the Constitution’s commerce clause. He explained, “The producers of greenhouse‑gas intensive products like steel or concrete could be regulated by Boulder, both within Colorado, but also throughout the United States, and also around the world because those have greenhouse‑gas implications.”

Prakash further warned that foreign governments might use the same legal reasoning to impose U.S. energy standards on American businesses, stating, “[Boulder] can regulate the entire United States because of the effects that are felt within their jurisdiction and then they can go further and regulate the entire world.”

Other legal experts echo the warning

George Mason University law professor Todd Zywicki described the lawsuit as an attempt by a “bunch of hippies in Boulder County” to dictate how the rest of the country lives, adding that it would unfairly limit access to inexpensive fossil fuels for people worldwide. Zywicki noted that the Clean Air Act does not give states a blank‑check to fill regulatory gaps left by federal law.

Cooper & Kirk partner Megan Wold agreed, emphasizing that while the Clean Air Act leaves certain issues unaddressed, those gaps do not automatically become state authority under federal common law. “Passing the Clean Air Act and leaving some gaps about certain things that aren’t directly regulated doesn’t mean those gaps are free from the structures of the federal common law that preceded them,” she said.

Potential impact on future climate litigation

If the Supreme Court sides with Boulder County, the decision could open the door for other local jurisdictions to pursue similar lawsuits, potentially creating a patchwork of climate regulations that vary from one city or county to the next. Critics argue that such a fragmented approach would undermine uniform national policy and could hamper economic growth.

Supporters of the lawsuit contend that holding major emitters accountable is essential for protecting communities from the real‑world effects of climate change. However, the constitutional questions raised by the case suggest that any ruling must balance environmental goals with the limits imposed by the commerce clause.
