Polk County sets aside 1,500 voter‑registration challenges until after November election

Polk County, Iowa – In a hearing held Wednesday at the county elections office, Auditor and Commissioner of Elections Jamie Fitzgerald announced that challenges to roughly 1,500 voter registrations will be set aside until after the November election. The decision means no registered voter will be removed from the rolls or denied a ballot before the vote, preserving Iowa’s same‑day registration protections.

Why the challenges were paused

Fitzgerald explained that most of the challenged registrations were deemed inactive – a status that can arise when a voter misses an election or when election‑related mail is returned as undeliverable. Under Iowa Code Section 49.79, a registered voter may file a written challenge alleging that a registrant does not live at the address on file, is not a U.S. citizen, is under the voting age, or has other disqualifying factors. Each challenge must include the challenger’s name, address, phone number and signature, and the filer must swear the information is true, with false statements constituting an aggravated misdemeanor.

Local impact and voter reaction

One of the voters affected, Gerard Neugent, said he was “miffed” when he received a challenge letter that mistakenly identified another resident as the filer. Neugent’s case involved two challenges that claimed he no longer lived in Iowa because he had moved to Wisconsin and registered there. He believes the claims confused him with his son and grandson, who do reside in Wisconsin and vote there.

“I was very surprised, and I would say that I was miffed,” Neugent told KCCI. He clarified that his frustration was directed at the challenge itself, not the Polk County Elections Office. Neugent expressed relief at the outcome and urged election officials to find a way to prevent unsupported challenges from intimidating eligible voters.

Data‑sharing and future improvements

Fitzgerald noted that more than 1,000 of the cases could have been identified earlier through the Electronic Registration Information Center (ERIC) – a multi‑state data‑sharing compact that Iowa left in 2023. “We were part of 27 states where they shared information; they shared where your Social Security was going, if you moved, and everybody shared information,” he said. While ERIC was not a federal program, its withdrawal has complicated the verification of residency changes.

During the hearing, the challengers declined to speak or comment, and they also declined KCCI’s request for further remarks after the session.

Outcome of the hearing

According to Fitzgerald, about 200 challenges were denied for reasons such as missing birth‑date information or lack of confirmation that the registrants remained active voters. The remaining roughly 1,250 challenges will be addressed after the election, based on legal advice from the Polk County attorney.

The county’s decision to pause these challenges underscores Iowa’s commitment to ensuring that every eligible citizen can cast a ballot without undue delay. By keeping the registration rolls intact through Election Day, Polk County upholds the principle that voting is a fundamental right, not a privilege to be withheld on procedural technicalities.
