Virginia School District Sued Over Alleged Policy

America First Legal filed a federal lawsuit against Fairfax County Public Schools, alleging that the district’s policy allows school staff to withhold information about a student’s gender transition from their parents. The lawsuit claims that this policy infringes on the U.S. and Virginia constitutions, which protect parents’ right to direct their children’s upbringing, education, and religious development.

Policy Details

The policy in question, Regulation 2603.3, allegedly directs school staff to support and facilitate a student’s social ‘gender transition’ at school without notifying parents or obtaining their consent. It also mandates that school staff use a student’s preferred pronouns and name, and allows students to use sex-segregated facilities based on their self-identified ‘gender identity.’ Additionally, the policy permits students to participate in gendered classes, activities, and programs based on their self-identified ‘gender identity.’

The lawsuit argues that these policies overstep the authority of school employees and violate parents’ constitutional rights. America First Legal’s senior counsel, Ian Prior, stated that the school district was given an opportunity to correct its policies but failed to do so, and will now face the consequences.

Response from the School District

A spokesperson for Fairfax County Public Schools said that the district is committed to creating an inclusive environment for all students and staff, including transgender and gender-expansive students. The spokesperson added that the district will respond to the lawsuit through the appropriate legal process after completing its review of the complaint.
