Wyland sues after Dallas, FIFA erase beloved ‘Whaling Wall’ mural

Artist Wyland has filed a cease-and-desist and opened a legal fight after his long-standing Whaling Wall mural in downtown Dallas was painted over to make way for a FIFA World Cup display; the dispute names FIFA, the North Texas World Cup Organizing Committee and the city of Dallas and was covered by FOX 4 with reporter Peyton Yager on the story.

Work to cover Wyland’s mural started last week in downtown Dallas, and the artist responded quickly by issuing a formal legal notice. The cease-and-desist cites the Visual Artists Rights Act of 1990, known as VARA, which protects certain moral rights of visual artists and requires a written waiver before altering or destroying public art. Wyland says he and the Wyland Foundation never authorized the change.

Wyland told FOX Local that claims he was contacted and gave permission are false, calling the assertion “a lie with a capital L.” He painted the piece, titled Ocean Life, nearly 30 years ago and intended it as more than decoration; the mural was meant to prompt conversations about how inland cities affect downstream ecosystems. That purpose matters now as the work becomes the center of a legal standoff.

People in Dallas reacted with a mix of anger, sadness and confusion after the mural’s removal was reported. Many current residents never saw Wyland paint the wall and were not familiar with the piece’s history or conservation message. The mural had functioned as a civic landmark and a talking point about environmental stewardship for decades.

Wyland argues cities are limited in their ability to destroy public artwork once it is installed, even when the piece sits on privately owned buildings. Although he gifted Ocean Life to Dallas, federal law recognizes his moral rights and keeps the mural under his intellectual property protections unless he signs a waiver. That legal framework gives him standing to pursue action against those he believes responsible for the erasure.

The artist has made clear he intends to pursue the matter firmly and publicly. “They picked the wrong artist,” he said. “I can tell you that. I am going to go after them and go after them hard. I am going to ask the community of Dallas to stay with me. We are going to protect the other art in Dallas.”

Wyland estimates Ocean Life was worth at least $15 million, a figure he mentioned while discussing potential damages under VARA, though the law’s remedies can vary. He also said he will not pocket any settlement money; instead, he plans to donate recovered funds to local communities, conservation efforts and school art programs. That pledge shifts the focus toward community benefit and the preservation of public culture.

Questions swirled about whether the artist had a contract or an agreement guaranteeing payment if the mural was removed. Wyland denied rumors of a secret payout deal and emphasized that VARA is the main source of protection for his work. Meanwhile, the city of Dallas, FIFA and building owner Slate Asset Management all received inquiries, and communications have been described differently by each party involved.

FIFA has said it plans to unveil a new piece tied to the World Cup event and framed the work as capturing a “current historical moment.” The organization released a statement explaining it intends the mural to reflect the energy and global spirit around World Cup 2026. That stance sits against Wyland’s insistence that neither he nor the Wyland Foundation granted permission for the original mural’s removal.

Wyland has also explained why he paints whales in places like Dallas: to spark conversation about human impacts on distant ecosystems. He sees murals in landlocked cities as a way to make people consider downstream consequences and to ask questions about stewardship. “At first, it just looks like a beautiful painting of whales,” Wyland said. “It’s more than that. It is really deep.”

Despite the dispute, Wyland said he still loves Dallas and wants to remain engaged with the city’s public art scene. He revealed plans for a new 100-series project featuring large-scale sculptures of animals listed on the IUCN Red List of Threatened Species, tailored to the locations that host them. The legal fight may be on now, but he also signaled a desire to keep contributing art and raising awareness.
