Small Businesses Oppose New Pro-Union Workplace Poster Bill

May 6, 2026

Bill threatens fines for not promoting well known right to unionize

There is a new bill introduced in Congress threatening small businesses who fail to comply with sweeping unionization mandates. NFIB sent letters of opposition to leaders of the U.S. Senate and U.S. House committees urging them to reject the legislation.

The so-called Know Your Labor Rights Act, H.R. 8418/S. 4366, would enforce fines on small businesses if they do not notify new hires of their right to unionize, putting small business owners in the position of promoting unionization. They will also be fined if they do not maintain a new workplace poster informing their employees of the right to unionize.

This would add a new level of federal government involvement into business operations and violate the First Amendment. The bill holds small business owners accountable for educating their employees about the right to unionize, which is currently the responsibility of the employee or union. NFIB urges Congress to reject the bill to prevent new compliance burdens for small businesses. Learn more about the bill and read NFIB’s letters of opposition.
