Washington voters approve Initiative 638 to keep girls’ sports limited to biological females

Seattle – On Thursday, Washington voters approved Initiative 638, the first statewide ballot measure to separate boys’ and girls’ sports based on biological sex. The measure passed with 56.8% support, according to FOX 13 Seattle, and now requires schools to verify a student’s biological sex through a health examination, genetic testing, or testosterone levels before allowing participation in girls’ athletics.

Local protest follows the vote

Supporters of transgender rights gathered at Westlake Park and marched toward Pike Place Market, chanting “638 is trans hate.” Evan Gortner of the Gender Equity Movement, which organized the rally, told KUOW the result was “devastating,” even though many had expected the measure to pass.

Who backed the initiative?

The conservative group Let’s Go Washington sponsored Initiative 638. Voters also rejected two other measures the group backed, one protecting parental rights and another seeking to repeal the state’s tax on high earners.

What the law requires

Under the new rule, a student must provide a health‑care provider’s statement confirming biological sex. Verification may be based on reproductive anatomy, genetic makeup, or naturally produced testosterone levels. The text does not dictate a specific test or examination, leaving schools to determine the appropriate process.

Legal and political response

Washington has allowed students to compete on teams consistent with their gender identity since 2007. The ACLU of Washington condemned the vote but did not announce any litigation plans. The Gender Justice League’s executive director, Danni Askini, said her organization is reviewing a possible privacy‑based challenge, though no lawsuit has been filed yet.

State Democrats said they will support any organization that chooses to challenge the initiative in court, but the party itself will not file a suit. Party Chair Shasti Conrad called the measure unconstitutional in a statement released on November 5.

Impact on schools

The Washington Interscholastic Activities Association (WIAA) said it is preparing new guidance and forms for schools, with a target implementation date of December 3, pending legal review. Schools will need to adjust physical‑examination procedures and update sports‑participation paperwork to comply with the new requirements.

Community reaction

Supporters argue the measure protects fairness, safety, and athletic opportunities for female students. Opponents contend it discriminates against transgender students and could force invasive medical verification. The debate has already sparked protests from female athletes, including a group of Camas girls who refused to race against a transgender teammate in October.

As the state prepares to enforce Initiative 638, the next weeks will likely see legal filings and continued public debate over the balance between protecting girls’ sports and ensuring the rights of transgender youth.
