Sen. Martin Heinrich asks BLM to reveal AI data‑center plans on federal lands

New Mexico Senator Martin Heinrich (D) is pressing the Bureau of Land Management (BLM) for a full accounting of proposed artificial‑intelligence data‑center projects on federal public lands. In a letter dated Nov. 6, Heinrich gave BLM Director Steve Pearce until Nov. 20 to disclose the legal authorities, project inventory, and land parcels under consideration.

Letter seeks transparency on 15+ proposals

Heinrich, the ranking Democrat on the Senate Energy and Natural Resources Committee, says the agency is reviewing at least 15 proposals that would use more than 17,000 acres in six western states. He wants to know which developers are involved, the exact locations, the size of each parcel, and whether the projects would include buildings, transmission lines, roads or other supporting infrastructure.

Environmental review under question

The senator is especially concerned that the Trump administration’s 2025 executive order – which prioritized fast‑track permitting for data‑center infrastructure – may have allowed projects to proceed without new reviews under the National Environmental Policy Act (NEPA). He cites the Townsite Data Center in Boulder City, Nevada, where BLM amended a solar‑energy right‑of‑way to permit a data center without a fresh NEPA analysis. The Interior Department’s Board of Land Appeals paused that project in September after finding the agency’s reasoning unpersuasive.

Why the scrutiny matters

Heinrich argues that accelerating data‑center approvals should not come at the expense of environmental safeguards or public input. Federal lands are managed under a multiple‑use framework that balances recreation, conservation, grazing, and energy development. The senator stresses that any decision must consider the best interests of nearby communities.

Executive orders and new authority

The November 2025 order from President Donald Trump identified data centers and their supporting energy infrastructure as permitting priorities. A second order in September 2026 gave Interior Secretary Doug Burgum additional authority over energy production and related development, further signaling the administration’s focus on expanding such facilities.

Potential impact on ratepayers

Research from the Federal Reserve Bank of Dallas, referenced by Organ Mountain News, found that data‑center demand lifted wholesale electricity prices in the Arizona‑New Mexico market by 8.6% during 2024‑25. Heinrich has introduced legislation aimed at protecting residential electricity customers from bearing the cost of large data‑center projects.

What the senator is asking for

  • A complete list of the federal authorities used to support data‑center development, including legal reasoning and precedents.
  • A comprehensive inventory of each proposal, with developer name, location, acreage, and intended use of the land.
  • Clarification on whether each project will undergo environmental review, if existing right‑of‑way approvals will require new reviews, and how the public can comment.
  • A full catalog of federal public lands identified as eligible for data‑center development.

Heinrich’s request comes amid growing scrutiny of the power and infrastructure demands of AI‑driven facilities. While the letter does not name any specific New Mexico sites, the senator’s inquiry could shed light on how many projects are under review and what opportunities local communities will have to weigh in.

Next steps

The BLM has until Nov. 20 to respond. Its answers could clarify the scope of federal land use for data‑center projects and inform ongoing debates about balancing economic development with environmental stewardship and community input.
