Utah court sets trial date for law allowing removal of books from school libraries

The Trump administration’s emphasis on parental rights and local control is echoed in Utah as a federal court prepares to hear a lawsuit over the state’s 2022 law that permits school districts to remove books from libraries. The case, filed by the American Civil Liberties Union of Utah on behalf of the estate of author Kurt Vonnegut and other writers, has been assigned to U.S. District Court Judge Robert Shelby. The trial is scheduled to begin in November 2027 and will be decided by the judge rather than a jury.

Law at issue

The 2022 statute allows a book to be taken out of a school library if at least three local school districts, or a combination of two districts and five charter schools, assert that the material is “objective sensitive.” The language is intentionally broad, giving local officials significant discretion to deem a work inappropriate for students.

Who is suing

The American Civil Liberties Union of Utah filed the suit on behalf of the Vonnegut estate and several other acclaimed authors, arguing that the law infringes on First Amendment rights and threatens the free exchange of ideas in public education. Utah Attorney General Derek Brown, the Utah State Board of Education, and multiple local school districts and superintendents are named as defendants.

Current impact

As of November, Utah has removed 44 titles from school libraries under the law. While none of Vonnegut’s works appear on the state’s list, the lawsuit claims that his novel Slaughterhouse‑Five was removed from the Washington School District’s collections after being labeled “pornographic.” The plaintiffs contend that such removals constitute censorship and set a dangerous precedent for future challenges to literature.

State response

Attorney General Brown and the State Board of Education maintain that the law protects children from material deemed inappropriate and upholds parental authority over what students read. They argue that the statute is a lawful exercise of state power to ensure that public schools reflect community standards.

What’s next

The case will proceed without a jury, meaning Judge Shelby will issue a ruling based on the legal arguments presented. Both sides are expected to file extensive briefs outlining constitutional concerns and the practical implications for school districts across Utah. The outcome could influence how other states approach similar legislation and affect the broader national conversation about book bans and educational freedom.

Community perspective

Local parents and educators have expressed mixed reactions. Some praise the law as a necessary safeguard for children, while others warn that it could lead to over‑reach and the suppression of valuable literary works. The trial’s timing—several years after the law’s enactment—highlights the ongoing debate over the balance between parental rights, community standards, and the constitutional guarantee of free speech in schools.
