Ohio Breeder Ordered to Surrender Over 1,100 Chinchillas After Federal Welfare Violations

JENERA, Ohio – Federal authorities have taken decisive action against a local chinchilla breeding operation after a multi‑year investigation uncovered serious animal‑welfare violations. The U.S. District Court for the Northern District of Ohio approved a consent decree on Nov. 2 that requires R & R Chinchilla Inc. and its owner, James F. Ritterspach, to surrender over 1,100 chinchillas and permanently cease all federally regulated breeding activities.

Background of the case

The Justice Department filed a complaint in August after the U.S. Department of Agriculture (USDA) referred the facility for inspection. USDA inspectors conducted 18 inspections beginning in September 2022 and documented 59 violations of the Animal Welfare Act over the past four years, including untreated medical conditions, dead animals, extreme waste buildup, and concealed animals hidden from officials.

Ritterspach repeatedly claimed the farm housed only 300‑450 chinchillas, yet inspectors discovered roughly 800 additional animals in a separate building that had been kept out of view for years. When USDA officials finally accessed the hidden structure on Aug. 5, they described the conditions as among the worst they had ever seen at an animal‑care facility.

Conditions found

Inspectors reported multiple dead chinchillas, animals suffering from untreated illnesses, and pervasive sanitation problems. Fecal matter covered the floors of hundreds of enclosures, and ammonia levels were so high that inspectors began coughing and had to leave the building. Additional findings included chinchillas with severely swollen eyes that could not open, open packets of rat poison stored next to enclosures, and an animal with a metal collar embedded in its neck. The complaint also described an incident in which Ritterspach allegedly held a chinchilla by its tail while ripping away a small mat of hair.

Legal action and settlement

The Justice Department and the U.S. Attorney’s Office for the Northern District of Ohio sought a temporary restraining order and preliminary injunction on Aug. 20. A federal judge granted the order the next day, later modifying it to require cooperation in removing approximately 800 animals.

Under the consent decree, Ritterspach must surrender the remaining chinchillas, permanently revoke his federal breeding license, and end any activity regulated under the Animal Welfare Act. The agreement also secured veterinary access for the animals over the preceding three months, allowing them to receive care before relocation.

Official statements

Principal Deputy Assistant Attorney General Adam Gustafson emphasized that federally licensed breeders have an obligation to provide clean water, adequate food, proper housing, and sufficient veterinary care. “The heart of the Animal Welfare Act is to make sure animals are receiving good care, and that is what happened here,” Gustafson said.

U.S. Attorney David Toepfer added that breeders cannot abuse animals, keep them in dirty cages, or neglect them to the point of suffering or death. USDA Animal Care Deputy Administrator Bernadette Juarez noted that the agency had issued an official warning in 2024 and pursued multiple enforcement actions, including two summary suspensions, before working with the Justice Department to resolve the case.

Impact on the community

R & R Chinchilla had been breeding chinchillas for more than 40 years, providing a local source of animals for the pet trade. The settlement ends that operation and offers the surrendered chinchillas a chance to receive proper care through animal‑welfare organizations. Federal officials said the case demonstrates the government’s willingness to enforce minimum care standards against licensed breeders who fail to meet them.
