Washington PDC pauses campaign contribution caps ahead of Nov. 3 election

Washington state’s Public Disclosure Commission (PDC) announced Tuesday that it will not enforce the short‑term contribution limits that normally apply during the final weeks before a primary or general election. The decision, made by a citizen‑panel of commissioners, affects candidates for legislative seats, the state Supreme Court and political committees that are not tied to a ballot measure.

Why the suspension?

Commissioners said the statute limiting contributions – $75,000 for legislative and statewide races and $7,500 for local offices during the seven‑day primary window and the 21‑day general‑election window – may not survive a legal challenge. “The law has not changed,” PDC spokesperson Natalie Johnson explained, “but the commission is concerned that the law on the books is not enforceable and is telling staff to not enforce it.”

The move is intended to avoid a situation where some candidates and committees know the limits are not being enforced while others do not, a fairness concern raised by longtime campaign‑finance activist Conner Edwards.

What remains in place?

Individual contribution limits to candidates are still active, and any contribution of $1,500 or more from a single source must be reported within 48 hours during the 21‑day pre‑election period. The PDC’s suspension applies only to the short‑term caps on how much a candidate can give themselves or a committee can accept in that narrow window.

Reactions from the political community

Republican consultant Chad Minnick acknowledged that a handful of large, late‑stage contributions have already occurred, but he believes the timing limits the overall impact. “To have much impact you need to have money a few weeks out. At this stage most of the people have made up their minds,” he said.

Democratic consultant Dean Nielsen echoed that sentiment, noting that most campaigns were already operating under the 21‑day rules. “I don’t really think it will matter a lot this year,” he said, “but I do think it will have a major application for the future.”

Legal backdrop

The suspension follows a 2025 complaint against judicial candidate Tam Bui, who paid $41,000 for last‑minute mailers in a special election for the Washington Court of Appeals. The complaint cited the in‑kind contribution as giving an unfair advantage. Bui’s lawyers pointed to the 1976 U.S. Supreme Court decision in Buckley v. Valeo, which struck down federal limits on a candidate’s self‑funding.

Earlier, the PDC lost a 2011 case defending contribution limits for ballot‑measure committees, leading to an exemption for those groups. The agency also faced a 2025 dismissal of the Bui complaint, prompting staff to describe the statute as a “conundrum.” Executive Director Peter Frey Lavallee suggested the Legislature clarify the law when it reconvenes.

Looking ahead

Commissioners emphasized that the suspension is a temporary measure aimed at preserving fairness while the legal status of the statute remains uncertain. They indicated that any future enforcement will likely depend on legislative action or a definitive court ruling.

Election professionals expressed concern that the pause could allow large sums of money to flow to committees actively supporting or opposing candidates in the upcoming November 3 election. Retired reporter Dave Ammons warned that “huge late infusions of money can influence outcomes that may not be known until after the election.”

For now, Washington voters and candidates will navigate the race without the short‑term caps, while the PDC monitors the situation and prepares to adjust its approach based on forthcoming legal guidance.
