Eugene Pays $23,400 Fine After Sediment Spill During Amazon Creek Restoration

The Oregon Department of Environmental Quality (DEQ) issued a $23,400 civil penalty to the City of Eugene for pollution caused by erosion during the Amazon Creek Restoration Project. The fine was listed in DEQ’s monthly violations roster released on Oct. 26.

What happened

During the 2024‑2026 restoration, crews removed a 65‑year‑old concrete wall along Amazon Creek between 24th and 20th Avenues and replanted a sloping bank with native vegetation. The project, funded by a $2.7 million FEMA grant, required a state 401 Water Quality Certification, which mandates strict control of soil movement into state waters.

DEQ’s letter to City Manager Jenny Haruyama noted that on or about Aug. 17, 2024 a diversion pipe failed, flooding the work area. An excavator was parked in the creek channel, and two additional machines sat on exposed soil. The compliance manager observed that the isolation dam was non‑functional, erosion control measures were missing on most banks, and uncovered stockpiles were not stabilized. Best‑management practices such as perimeter sediment controls and matting were insufficiently installed.

City’s response

Marion Suitor, spokesperson for the city’s Public Works Department, told Lookout Eugene‑Springfield that heavy summer rains contributed to the problem. She said the city was following an approved temporary water‑management plan when two major rain events caused sediment and construction debris to escape the controls. The city worked with DEQ to correct the deficiencies and reported that no further discharges occurred after the issues were addressed.

Violations continued on three additional days before the city achieved compliance on Sept. 25, 2024. The city has since paid the assessed fine.

Why it matters

Erosion is classified as pollution when it degrades water quality or harms aquatic life. Excess sediment can bury food sources and smother organisms, affecting downstream ecosystems. The incident underscores the importance of rigorous erosion‑control measures on public‑works projects, especially when federal funds are involved.

Amazon Creek flows north then west through Eugene before joining the Long Tom River, making its health a concern for local residents, anglers, and downstream communities.
