Attorney General Wrigley Declines Probe of Development Fund Over Conflict Concerns

Bismarck, N.D. – State Attorney General Drew Wrigley announced that his office will not open an investigation into the North Dakota Development Fund, citing a direct conflict of interest. The Development Fund, created to provide financing for businesses that traditional lenders often avoid, has come under scrutiny after an audit highlighted roughly $4 million in missing or incomplete records.

Conflict of interest cited

Wrigley explained that his office is presently representing several individuals who sit on the Development Fund’s Board of Directors. Because of that representation, he said pursuing a probe would violate ethical standards and could compromise the integrity of any potential findings. “We must avoid any appearance of impropriety,” Wrigley said in a statement released to the press.

Democratic criticism

Democratic leaders in the state seized on the decision, arguing that the refusal to investigate signals a broader pattern of “waste, fraud, and abuse” among Republican officials. “Again and again we see waste, fraud, and abuse from the Republican lawmakers and a culture of lawlessness in the executive branch,” a Democratic spokesperson said, urging the legislature to take action.

Election backdrop

The controversy emerges as Wrigley prepares for his 2026 re‑election campaign. He faces Democratic challenger Tim Lamb, who has pledged greater transparency and oversight of state‑funded programs. While the Development Fund controversy could become a campaign issue, Wrigley’s office maintains that the decision not to investigate is rooted in legal ethics, not political calculation.

What the Development Fund does

Established to stimulate economic growth, the Development Fund offers loans and equity investments to startups and expanding companies that might otherwise struggle to secure capital. Supporters argue the fund has helped launch dozens of businesses across the state, contributing to job creation and rural development.

Audit findings

The recent audit, conducted by the state auditor’s office, identified $4 million in transactions lacking complete documentation. While the audit flagged the gaps, it did not allege criminal wrongdoing. State officials have said they are reviewing the findings to improve record‑keeping practices.

Next steps

With the Attorney General’s office stepping back, oversight responsibility may shift to the Legislative Assembly’s Finance Committee, which has the authority to request further information from the Development Fund’s board. Both parties have indicated they will monitor the situation closely as the election cycle intensifies.

Community response

Local business owners expressed mixed reactions. Some praised the fund’s role in providing essential capital, while others called for greater transparency to ensure taxpayer dollars are used responsibly. “We need to know that the money is being managed properly,” said one Bismarck entrepreneur who prefers to remain unnamed.

As the 2026 election approaches, North Dakota voters will weigh the Attorney General’s handling of this issue alongside broader concerns about fiscal stewardship and ethical governance.
